This regulatory framework is designed to monitor substances that present significant health or physical hazards through a comprehensive reporting and filing system.

Compliance is mandatory for all entities involved in the supply chain of designated chemicals. These include manufacturers who produce PMCs for sale or use, importers bringing regulated substances into the local market, suppliers engaged in wholesale or retail activities, and employers who allow workers to handle or store these chemicals. By requiring these operators to disclose operational data—including basic operator information and specific handling details—the Ministry of Labor (MOL) can effectively assess and control exposure risks across industrial sites.

Substances Covered in the PMC System

The PMC system categorizes hazardous chemicals into three primary groups based on their hazard profiles as defined by the CNS 15030 standards.

  • Article 2, Item 1: Chemicals hazardous to sensitive populations
    This category includes approximately 96 specified chemicals, such as lead compounds, mercury, chlorine gas, and hydrogen cyanide, which pose particular risks to minors and pregnant or postpartum women.
  • Article 2, Item 2: High-risk substances (CMR Category 1)
    This encompasses substances classified as Category 1 carcinogens, mutagens, or reproductive toxins (CMRs). It also includes Category 1 respiratory sensitizers, substances causing serious eye damage, and specific target organ toxicants via repeated exposure. The current list identifies nearly 900 chemicals, including both pure substances and mixtures.
  • Article 2, Item 3: Other designated hazardous chemicals
    This category includes over 160 chemicals with specific physical or health hazards as designated by the competent authority. These substances often trigger reporting obligations based on their operational volume and hazard characteristics.

Exemptions are granted for certain products such as industrial waste, tobacco, food, beverages, medicinal products, cosmetics, and finished consumer goods not intended for industrial use.

Reporting Procedures and Deadlines

The PMC regulation requires both initial and periodic reporting to ensure the government's database remains current.

Submission Cycles

  • Initial Reporting: New operators must file their first report within 30 days of commencing operations involving PMCs.
  • Regular Reporting: For substances listed under Article 2, Items 1 and 2, annual updates must be submitted between April and September.
  • Semi-annual and Dynamic Reporting: For substances under Article 2, Item 3, reporting occurs every January and July. Additionally, dynamic reporting must be completed within 30 days if the maximum operational quantity exceeds the previously reported thresholds.

Failure to comply with these reporting windows or providing inaccurate data can result in administrative fines ranging from NT$30,000 to NT$300,000 per violation.
