Although a PPORD notification grants an exemption from the registration process, companies must still fulfill other regulatory obligations. These include adhering to authorization and restriction requirements and providing a Safety Data Sheet (SDS) where necessary.

Eligibility for PPORD Notifiers

Only specific legal entities within the European supply chain are eligible to submit a PPORD notification to the European Chemicals Agency (ECHA).

  • EU Manufacturers: Companies producing substances within the European Economic Area for research purposes.
  • EU Importers: Entities bringing substances from non-EU countries into the European market for innovation.
  • Only Representative (OR): A designated representative who acts on behalf of a non-EU manufacturer to fulfill REACH obligations.

The exemption obtained through this notification is valid for an initial period of 5 years. If the research and development activities require more time, companies may apply for an extension to prolong the exemption period.

Information Requirements for Submission

A successful PPORD notification requires the submission of detailed technical and administrative data to ECHA.

  • Notifier Identity: Full legal and contact information of the manufacturer, importer, or OR.
  • Substance Data: Detailed information regarding the substance identity, including identification analysis and hazard classification.
  • PPORD Activities: Information about the specific R&D activities, including estimated annual tonnage and a list of customers involved in the research.

It is important to note that ECHA may request additional information during the review process and can impose specific conditions of use to ensure safe handling during the research phase.

Key Considerations Before Notification

Before submitting a PPORD notification, companies must verify that their activities fall strictly within the legal scope of the exemption.

  • Research Purpose: The substance must be manufactured or imported solely for PPORD purposes; standard registration is still required if used for any other purpose.
  • Restricted Access: The substance and its research results must only be accessible to the notifier and listed customers; it cannot be made available to the general public.
  • Risk Management: Appropriate measures must be implemented to ensure the substance is handled under reasonably controlled conditions to protect workers and the environment.
  • Traceability and Disposal: Notifiers must track the quantities used and ensure that any remaining quantities are recollected for proper disposal or registered before further use.
