Understanding the CUS Code

EU CUS Code

The Customs Union and Statistics Code (CUS Code) is a unique 8-digit identifier assigned to chemical substances listed in the European Customs Inventory of Chemical Substances (ECICS). Managed by the European Commission's Directorate-General for Taxation and Customs Union (DG TAXUD), ECICS serves as a comprehensive database providing details on the customs classification and characteristics of chemical substances.

Each chemical listed in ECICS is assigned a unique code, such as 0011481-8 for barium sulfide. These codes are essential for facilitating seamless database searches and clear communication with EU customs authorities.

Importance of CUS Codes in Trade

Under the Import Control System 2 (ICS2), economic operators—including carriers, freight forwarders, and logistics companies—must submit an Entry Summary Declaration (ENS) before goods enter EU customs territory. Providing a CUS Code for chemical products is strongly recommended as part of this security and safety data submission.

For pure substances, economic operators are encouraged to provide the CUS Code from ECICS alongside the precise chemical name during customs declarations. In cases where a specific code is unavailable for mixtures or preparations, operators should provide a detailed description of the composition, preferably indicating the CUS codes of the constituent substances. This practice helps in accurate tariff classification and identifies products that may require specific regulatory attention, such as hazardous substances.

Application Process for New Codes

If a chemical is not currently listed in ECICS and has no assigned CUS code, businesses can apply for a new code. The application process generally involves three stages:

  • Data Collection: Gathering detailed product data, including chemical name, CAS number, composition, structure, and Safety Data Sheet (SDS).
  • Document Preparation and Submission: Preparing and submitting the formal application to DG TAXUD.
  • Follow-up and Issuance: Coordinating with DG TAXUD for any additional information required until the CUS code is officially issued.

The timeline for issuance depends on the complexity of the substance; for instance, polymers may require extended review. On average, the process can take several months.

Substances Covered in ECICS

The ECICS database currently contains tens of thousands of records covering a wide range of significant substances:

  • Pesticides and plant protection products (ISO 1750).
  • Pharmaceuticals with WHO-assigned International Nonproprietary Names (INNs).
  • Narcotic and psychotropic substances and their precursors.
  • Ozone-depleting substances (ODS) and substances controlled under the Chemical Weapons Convention (CWC).
  • Substances subject to Prior Informed Consent (PIC) procedures.
  • Other import/export-controlled goods and commercially significant chemicals.
